Parent Association Program Sweepstakes
NO PURCHASE IS NECESSARY TO PARTICIPATE OR WIN. APPLICABLE ONLY IN THE UNITED STATES. YOUR ENTRY INTO THE SWEEPSTAKES CONSTITUTES ACCEPTANCE OF THESE OFFICIAL RULES. VOID WHERE PROHIBITED.
The below Official Rules apply to the Ben’s Beginners™: Parent Association Program Sweepstakes (hereinafter, "Sweepstakes") offered by Mars Food US (hereinafter, the “Sponsor”). The purpose of this Sweepstakes is to promote parents cooking with their children as a means of teaching healthier eating habits for life. Cooking with your children makes for a great beginning!
To be eligible to participate in the Sweepstakes, you (“You”) must be: (i) above the age of majority in your state of residence; (ii) a member of the Parent Teacher Association or a member of the Parent Teacher Organization or an active participant in your school’s parent group (“Parent Association”) for the duration of the Entry Period (defined below); and (iii) a legal resident of the fifty (50) United States, including the District of Columbia. Employees and representatives of Mars, its affiliated companies, agents, and their immediate family members (defined as spouse, parents, siblings and children) and persons living in the same household, are not eligible to participate or win. Sponsor reserves the right to verify eligibility and to adjudicate on any dispute at any time. This Sweepstakes is subject to all applicable federal, state, and local laws.
B. THE SPONSOR
Mars Food US, 2001 E. Cashdan Street, Rancho Dominguez, CA 90220 is the Sponsor of this Sweepstakes.
C. PERSONAL INFORMATION
The Sponsor will be collecting personal information about You when You submit an entry into the Sweepstakes. The Sponsor will use and share this personal information in order to fulfill the requirements of the Sweepstakes. For example, the Sponsor may share this personal information with third parties who are randomly drawing from email sharing submissions, contacting entrants or potential winners. By entering this Sweepstakes and agreeing to these Official Rules, You hereby consent to the Sponsor using the personal information in this manner.
The Sweepstakes will launch on August 26, 2015. Entries will be accepted between 9:00 a.m. Pacific Time (“PT”) on August 26, 2015 through 11:59 p.m. PT on October 5, 2015 (“Entry Period”). The winners will be announced on or about October 24, 2014. Unless otherwise noted, for all times provided in these Official Rules or in relation to the Sweepstakes, the applicable time zone shall be Pacific Time.
E. HOW TO PARTICIPATE
NO PURCHASE IS NECESSARY TO PARTICIPATE OR WIN.
To enter, during the Entry Period, you can visit the Ben’s Beginners website and click on the link for the Parent Association Promotion, which can also be found at www.unclebens.com/ben's-beginners/for-schools (“Sweepstakes Site”). You must register with the requested information, including Your first and last name, (ii) email address, and (iii) school affiliation. Next, You will be prompted to input a minimum of one (1) to as many as three (3) email addresses and click "Share" to deliver a pre-populated message to those recipients with information about the Ben's Beginners National Contest (collectively referred to as “Entry Materials”). All email addresses will be evaluated by the Sponsor to determine if they meet the Email Sharing Requirements (defined below). Note: at any time during the Entry Period, the Sponsor may determine that an email address fails to meet the Email Sharing Requirements and may disqualify it from the Sweepstakes.
F. EMAIL Sharing REQUIREMENTS
To be eligible for any prize, You must register at the Sweepstakes Site and click "Share" to deliver a pre-populated message to one to three (1-3) email recipients with information about the Ben's Beginners National Contest (“Email Sharing Requirements”). You may share information with up to three (3) additional e-mail addresses per calendar day for the duration of the Entry Period. Please note that the number of email shares will not be evaluated in determining the winner of a prize, but will increase Your chances of being selected as a prize winner. The prize winners will be selected by a random drawing. To be clear, you may share emails as follows:
- Once the Parent Association has registered on the Sweepstakes Site, they can input a minimum of one (1) and as many as three (3) email addresses and click "Share" to deliver a pre-populated message to those recipients with information about the Ben's Beginners National Contest.
- By entering at least one and as many as 3 email addresses, You will earn one entry into the Sweepstakes.
- You are permitted to earn one Sweepstakes entry per calendar date by sharing emails with up to three (3) email addresses each day for the duration of the Entry Period.
- After You click "Share" and the emails are sent, a message will appear confirming Your Sweepstakes entry and encouraging You to return each day for another opportunity to share the message for more entries.
- In the event of a malfunction in the system, a message will appear prompting You to try the process again.
LIMIT: Limit one entry per calendar day. To be eligible, the Sponsor must receive your Entry Materials prior to the end of the Entry Period. Entry Materials that arrive after the end of the Entry Period will not be considered. The email addresses entered will be stored and checked with each entry so as to prevent repeat recipients and to confirm that an appropriate email address is being used. Please note that repeat email addresses, invalid email addresses, and email addresses that have been opted out of receiving messages from Sponsor will be ineligible for submission in connection with the Sweepstakes.
All Entry Materials become the property of the Sponsor. They will not be returned or acknowledged. The Sponsor is not responsible for lost, late, misdirected, incomplete, illegible entries or Entry Materials, or for any computer-related, online, telephonic, or technical malfunctions that may occur. Entries and Entry Materials will be considered void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically reproduced or obtained through fraud or theft, or if they do not meet the Email Sharing Requirements. By participating you agree to be bound by these Official Rules.
G. INTELLECTUAL PROPERTY RIGHTS
Warranty. By entering the Sweepstakes, You warrant and represent that the email addresses submitted by You are valid emails.
License. By submitting an entry into the Sweepstakes, You, grant to the Sponsor the right, without limitation, to display your name and school affiliation online and in any media now known or hereinafter developed. Further, You, agree to grant to the Sponsor all rights of ownership, reproduction, and use of the Entry Materials, for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit the Entry Materials.
Five (5) randomly selected entrants will each receive a prize consisting of a five hundred dollar ($500) check (the “Prize”). The five hundred dollar check ($500) is encouraged to be donated to their school, but it is not required.
Total Approximate Retail Value (“ARV”) of all Prizes: $2,500. The odds of winning depend on the number of eligible entries received.
I. PRIZE TERMS
The Sponsor may, at its sole discretion, choose to substitute any one of the Prizes described in these Official Rules for one of equal or greater value. Further, the Sponsor reserves the right to expand or modify any of the Prizes described above. Unless stated otherwise, and except in the event the Prize is a charitable donation, no Prize transfer, assignment or substitution is permitted. All federal, state, and local taxes, fees, and surcharges are the sole responsibility of the winners.
J. WINNER SELECTION & NOTIFICATION
Winners will be randomly selected in a random drawing on or about October 12, 2015. Unless otherwise noted by Sponsor, Sponsor will notify potential winners by email. In that email, Sponsor will provide the potential winner with information on how to collect the Prize. All potential winners will be required to execute and return, within 7 days of issuance of notification, an affidavit of eligibility, assignment of rights, liability and (where legal) publicity release (“Prize Documents”). By entering, entrants grant permission for their names to be displayed in correlation with all advertising for the Uncle Ben’s® Brand, this Sweepstakes, and the Ben’s Beginners National Contest. If provided, You must sign the Prize Documents, and the Prize Documents must be returned to the Sponsor electronically, via the mechanism described by the Sponsor in the notification. These Prize Documents will also confirm acceptance of the Prize. If any Prize notification is returned as undeliverable, if a potential winner is found to be ineligible or not in compliance with these Official Rules, does not respond within the time period specified, or cannot accept the terms and conditions of being a potential winner, the Prize shall be considered forfeited and the Sponsor may, in its sole discretion, select an alternate randomly selected potential winner from all remaining eligible entries, time permitting.
Except where prohibited by law, by accepting any Prize, Prize winners consent to the Sponsor, its partners, affiliates and/or subsidiaries, use of winner’s name and school affiliation for advertising and publicity purposes in any and all media worldwide (including winners list) without additional compensation or notification.
L. ABILITY TO TERMINATE
The Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. If the Sponsor, in its sole discretion, determines that the Sweepstakes or any portion of the Sweepstakes is impractical, fraudulent, void, unlawful or if there are any technical or administrative malfunctions, errors or other problems that affect the structure, terms or lawful administration of the Sweepstakes, the Sponsor may terminate, cancel or otherwise modify the Sweepstakes in whole or in part. In the event of termination, winners will be selected from among eligible entries received prior to termination.
M. LIMITATION OF LIABILITY
By participating, all entrants and winners release the Sponsor, its affiliates, parent, and subsidiary companies, its employees, agents and officers, advertising and promotion agencies, as well as all others associated with the development and execution of the Sweepstakes (collectively, the “Released Parties”), from and against any and all liability with respect to or in any way arising from the Sweepstakes, the Prizes awarded in the Sweepstakes, or in any activities related to the Prizes offered or the Sweepstakes. The Sponsor and the Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to the Sweepstakes Site, or any registration or winner drawing.
Participants also agree (a) to be bound by these Official Rules; and (b) that the decisions of the Sponsor are final on all matters relating to the Sweepstakes.
Before being declared a winner, each randomly selected entrant may be required to sign an affidavit and release confirming compliance with these Official Rules and acceptance of the Prize as offered. By entering/accepting a Prize, entrants/winners (i) release the Sponsor and its agencies from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Sweepstakes, or participating in any Prize-related activity or the acceptance, use or misuse of any Prize, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from, and (ii) grant the Sponsor and its agencies the unrestricted rights, in their collective or individual discretion, to publish without any further compensation use of the entrant name, Mars division, Mars location (in whole or part) or Prize information for advertising and publicity purposes worldwide without limitation and without additional compensation, except where prohibited. If provided, the affidavit and release must be returned within the time period specified thereon or the selected entrant will be disqualified and the Prize forfeited.
The Sweepstakes is subject to all federal, state, and local laws. The Sweepstakes and these Official Rules are governed by the laws of California, without regard to the conflicts of law provisions.
All disputes, claims or demands that relate to these Official Rules will first be brought to the attention of the other party. The receiving party shall have sixty (60) days from the date of such notice to remedy the described breach or violation and notify the complaining party in writing of the resolution. If the dispute, claim or demand is not resolved to the satisfaction of the complainant within 60 days, the complainant may request an informal resolution conference (mediation), which if agreed to by the other party will be scheduled to occur within 21 days of the written response. Each party shall have the right to be represented at such a conference by counsel and will ensure that a decision-maker with full and complete authority to resolve the dispute attends the conference. Such conference will be in front of a third party mediator chosen by the parties. If the parties do not agree to conference or are unable to resolve a dispute after such a conference, the parties agree that exclusive jurisdiction for any dispute, claim or demand related in any way to these Official Rules will be decided by binding arbitration. All disputes between the parties, of whatsoever kind or nature arising out of these Official Rules, shall be submitted to JAMS for binding arbitration under its rules then in effect in the California area, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.
